Dealing With Injuries Under the Washington Product Liability Act

In the state of Washington, the legislature has adopted a statute named the Washington Product Liability Act (WPLA) that provides rules that business must follow to protect consumers against defective designs and dangerous products. This statute sets forth rules that concern the responsibility that companies have when manufacturing and selling products to consumers, and in many cases expedites the process for victims to pursue compensation for their injuries.

Under the WLPA, there are two tests that can be used to determine if a product is unreasonably dangerous:

  1. Does the product fail to meet the ordinary expectations of the consumer?
    This test considers whether the product was more dangerous than a reasonable consumer would expect. Factors that go into determine the results of this test, include the intrinsic nature of the product, the cost of the product, the seriousness of the potential harm from the defect, and the cost associated with minimizing the risk.
  2. What is the likelihood that the product will cause an injury or other type of harm?
    This is known as the risk and utility test. This test looks at whether the likelihood and severity of the injury is greater than the burden on the manufacturer to design a safer product that doesn’t impair the product's utility.
